Frequently Asked Questions

What is a Sentencing Mitigation Video?

Sentencing Mitigation videos are short documentaries featuring the defendant. Think of it as a character witness letter brought to life on video. This video includes in-depth interviews with the defendant and anyone in their life who would serve as a character or defense witness. This includes a wide variety of people; family, friends, mentors, employees, employers, mental health professionals, religious counselors, anyone with positive things tell the judge about the defendant. Instead of reading a letter, the sentencing judge SEES the people who are pleading for mercy for the defendant.

What is a Pre-Charging Mitigation Video?

To Charge or not to Charge?

A Pre-Charging video is produced to show positive aspects of your client, which may affect the prosecution’s decision whether to charge that client with a crime. A Pre-Charging Mitigation Video is created before formal charging decisions are made. It provides prosecutors with additional context about the client’s background, character, family responsibilities, rehabilitation efforts, military service, employment history, medical issues, and other mitigating circumstances that may be relevant during the charging process.

When should a mitigation video be considered?

Every case is different. Defense counsel determines whether a mitigation video may be beneficial based on the facts of the case, the sentencing strategy, and the circumstances of the client. The earlier the planning begins, the more time there is to identify witnesses, gather supporting materials, and thoughtfully prepare the presentation.

Who should appear in a mitigation video?

The most effective witnesses are those who genuinely know the client and can provide meaningful insight into the individual’s life and character. Depending on the case, interviews may include family members, employers, coworkers, physicians, counselors, clergy, teachers, military colleagues, mentors, community leaders, and others.

Does the client always appear in the video?

Not necessarily. Some mitigation presentations include interviews with the client, while others focus primarily on family members, professional colleagues, and other supporting witnesses. The decision is made collaboratively with defense counsel based on the overall legal strategy.

How long should a mitigation video be?

There is no standard length. The appropriate duration depends on the complexity of the case, the number of witnesses, and the information being presented. Our objective is always to present meaningful mitigation evidence clearly and respectfully without including unnecessary material. We aim to bring in our videos in under 15 minutes, so the judge does not lose interest. That said, some defendants have so many compelling character witnesses and are so engaging and emotional in their interviews, they deserve more time. The defense attorney has the final word on what will be included.

Both.

Many interviews are now conducted remotely using professionally managed video conferencing, allowing witnesses across the country and the world to participate at their convenience. When appropriate, interviews may also be conducted on location or through a combination of remote and in-person interviews.

Are remote interviews accepted by the courts?

Yes. Since the widespread adoption of remote technology, courts now use virtual interviews and testimony for hearings, and other court proceedings. Remote interviews have become an effective way to include important witnesses who might otherwise be unable to participate because of travel, costs, scheduling, or distance.

How long does the process take?

The timeline varies depending on the complexity of the case, the number of witnesses, scheduling availability, and upcoming court deadlines. We work closely with defense counsel to meet the scheduling requirements of each case.

Do you travel?

Yes. Legal Video Concepts works with criminal defense attorneys throughout the United States. Depending on the needs of the case, interviews may be conducted remotely, on location, or through a combination of both.

Is everything confidential?

Absolutely.

Every case is handled with discretion and professionalism. We work directly with defense counsel and treat all client information, interviews, materials, and all communication with defense counsel as confidential.

Can you work with our mitigation specialist or sentencing consultant?

Yes.

We collaborate with criminal defense attorneys and other members of the defense team. Our goal is to integrate seamlessly into the overall mitigation strategy while producing a thoughtful and professional presentation.

We also work with medical professionals retained by defense counsel. Psychotherapists, psychiatrists, religious counselors, medical doctors, any professional who could serve the defendant /client well.

What makes Legal Video Concepts different?

Legal Video Concepts focuses exclusively on Sentencing Mitigation Videos and Pre-Charging Disposition Videos.

We are not a general production company that occasionally works on legal matters. Our entire process—from planning and witness interviews to editing and delivery—is designed specifically for criminal defense mitigation presentations.

Our philosophy is simple:

Credibility and success are more important than production value.

Every decision we make is intended to help the defense attorney present the best possible version of the client and to help the Court to better understand the individual while maintaining the dignity of the judicial process.
